Contest/Prize Disclaimer
Massage & Myotherapy Australia (hereafter referred to as the ‘Association’), will conduct its contest substantially as described in these general contesting rules, and by participating, each participant agrees as follows:
1. Prize. The prize that may be awarded to eligible winners is not transferable, redeemable for cash or exchangeable for any other prize. The prize must be redeemed within 30 days of the winners being notified by the Association unless otherwise stated in the contest’s official rules. If a winner cannot be contacted or is disqualified for any reason, the Association reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.
2. Eligibility and Limitations. Winners must be a member of the Association and compliant in their membership. Employees/Board members of the Association, the Contest’s participating sponsors and their advertising agencies, employees, and members of the immediate family of any such persons are not eligible to participate and win. The term ‘immediate family’ includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as ‘in-laws,’ or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. Prizes are limited to one (1) per person. Members who have already previously completed the course and wish to enter the Contest may do so by emailing a copy of their completion certificate to the Association before the Contest deadline.
3. PR, Publicity, Promotion; Use of Personal Information. By participating in a contest, where allowed by law, all participants and winners grant the Association exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, where allowed by law, participants agree that the Association may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
4. Release. By participating in the Contest, each participant and winner waives any and all claims of liability against the Association, its employees and agents, the Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize.
5. Opt Out. Members of the Association who wish to claim Continuing Professional Education (CPE) for completing the Cyber Wardens ‘Cyber security course for small businesses’ but do not wish to participate in the Contest may opt-out of the prize-running by notifying the Association in writing when submitting their completion certificate that they do not wish to participate.
6. Taxes. Winners are solely responsible for paying any and all applicable taxes and duties related to the prize. Gift cards will be sent by discreet standard post and the Association will cover any expenses associated with shipping and handling Prizes to the Contest winners. The Association takes no responsibility for the loss of prizes due to incorrect or imprecise delivery details provided by an entrant or errors during shipping.
7. Miscellaneous. Void where prohibited. Odds of winning depend upon the number of participants. The Association may discontinue the Contest at any time. The Association disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.
Terms and Conditions – Competition Prize Delivery
1. Delivery of Prizes
Massage & Myotherapy Australia will arrange for the delivery of competition prizes through Australia Post. The Association will endeavour to ensure the timely dispatch of prizes to the winners’ provided addresses.
2. Responsibility for Delivery
Once the prize has been dispatched, responsibility for the successful delivery passes to Australia Post. Massage & Myotherapy Australia is not responsible for any delays, loss, or damage incurred during the delivery process.
3. Correct Address
It is the responsibility of competition winners to provide accurate and complete delivery details. The Association will not be liable for any incorrect delivery caused by inaccurate information provided by the winner.
4. Lost or Damaged Items
Massage & Myotherapy Australia is not responsible for prizes that are lost, delayed, or damaged once they are in the care of Australia Post. Any claims or issues related to loss or damage of the prize must be made directly with Australia Post.
5. Delivery Timeframe
While the Association will make every reasonable effort to ensure the prompt delivery of prizes, no guarantees are made regarding the timeframe of delivery. Australia Post’s standard delivery times and procedures will apply.
6. No Replacements
In the event of loss or damage during delivery, Massage & Myotherapy Australia is under no obligation to replace or provide an alternative prize.
7. Force Majeure
The Association will not be held liable for any failure to deliver prizes due to events outside of its reasonable control, including but not limited to postal strikes, natural disasters, or other unforeseen events.
